We have been providing probate loans to heirs of Probate Estates and to trust beneficiaries in the state of California for over twenty years. We are not concerned if you have poor credit, bad credit or even no income because if you are the Executor or Administrator of a Probate Estate we can make a mortgage loan based on the equity of the Probate owned real estate. Your past credit history or limited income will not be a problem for us offering you the money you need. We strive to make the process as smooth and seamless as possible for our Borrowers.
The money can be used for the following:
- Paying outstanding attorney fees
- Paying any court costs or fees
- Paying monthly payments or paying off in full creditors of the Probate Estate or beneficiary
- Making any necessary or desired property repairs to the properties owned by the Probate Estate
- Paying taxes or other obligations owing by the Probate Estate
- Paying funeral and burial expenses of the deceased
- Paying ongoing expenses owned by the Probate Estate
- Paying claims submitted by the executor of the Probate Estate
- Paying professional expenses such as accountants for preparing estate tax returns
- Paying preliminary distribution expenses to one or more beneficiary to the Probate Estate
INTEREST IMPOUND RESERVES
Typically, most of the Probate Loans that we fund can be “Over-funded” to set up an Interest Impound Reserve Account to cover required monthly interest payments due until the probate receives the Order for Final Distribution from the probate court. If there are any unused funds remaining in the Interest Impound Reserve Account, then the money can be distributed as estate proceeds due to the Beneficiary.
We work directly with the Estate Attorney or Executor/Administrators of the Estate to work out all of the necessary details and court approvals for the Probate Estate. Under most circumstances our Private Equity Loan can be paid back from assets of the estate, so in most circumstances our Borrower doesn’t need to make any monthly payments. We provide needed funds to meet financial obligations of the Probate Estate prior to final court settlement. Emergency cash is available when needed.
Our Probate Loans are designed for probates that require immediate financing for needed obligations and for beneficiaries who are in need of funds prior to the completion of the probating of estate and the ultimate estate distribution.
If the requested financing requires court approval, we can prepare and arrange to deliver to the court the necessary documentation and financing disclosures sufficient for the court to approve the requested estate financing.
Our terms and costs vary depending on the complexity of the Probate Estate and the time necessary to fully administer and distribute the assets of the estate.
